Appeals to the Board of Immigration Appeals and Administrative Appeals Office

In the event that USCIS denies or revokes a petition or application, the applicant or petitioner may generally file an appeal of that decision with the Administrative Appeals Office (AAO) or Board of Immigration Appeals (BIA).  There are strict deadlines for filing an appeal.  An appeal may be accompanied by a legal brief in support of the appeal, in order to convince the AAO or BIA that USCIS erred in its denial of the petition or application in question.

 

Certain USCIS denials or revocations may warrant the filing of a motion to reopen or motion to reconsider with USCIS, rather than an appeal.
